This next phase of the project is nearing completion. This phase had involved developing the details for the shared infrastructure for West Byron. This has been undertaken by BBWLA and its contractors. The Development Control Plan for West Byron is being undertaken by Byron Shire Council. Currently the Council and BBWLA are before the Land & Environment Court.
If the Development Application (DA) is accepted, the process will require submission of Construction Certificates before the subdivision construction can occur, manage the construction of various stages of the release area and register the subdivisions.
Public exhibition of the draft package of information and plans for the West Byron rezoning proposal closed on 31 January 2014.
The Department of Planning and Infrastructure is now reviewing submissions. The community will have further opportunities for input and feedback.
The draft package of information and plans for the West Byron site proposal are currently on exhibition by the Department of Planning and Infrastructure.
Submissions are invited until 31 January 2014.

The draft package of plans and agreement on exhibition can be viewed on line at www.planning.nsw.gov.au/on-exhibition or hard copies of these documents can also be viewed until 31 January 2014 during regular business hours, at:
- Department of Planning & Infrastructure, Information Centre, 23-33 Bridge Street, Sydney;
- Department of Planning & Infrastructure (Grafton Office), Level 3, 49 Victoria Street, Grafton;
- Byron Shire Council, 70–90 Station Street, Mullumbimby; and
- Byron Bay Library, Corner of Lawson and Fletcher Streets, Byron Bay.
The proposal will only be finalised after all submissions have been considered. Have your say and lodge your submissions at www.planning.nsw.gov.au/on-exhibition for the revised plans and/or the Voluntary Planning Agreement. Your submissions are important- the zoning plan, planning rules and Draft Development Control Plan 2013 (DCP) will be finalised after consideration of all submissions.
